Expectations are for Ashton Woods to be the builder in Phase 1B (55 single family homes), Phase 3B (37 single family homes) and Phase 4 (46 single family homes).
In moving forward with plans to develop a new home community, property owners/developers will typically make significant investments in site evaluation, planning, architecture/engineering, consultant fees, and other costs — before obtaining a building permit. During the planning, local zoning or land-use regulations could change before construction on the new home community begins, potentially invalidating their plans. A primary purpose of The Vested Rights Act adopted in 2004 by the South Carolina Legislature, was to bring certainty and fairness to new home community development by protecting developers from retroactive regulatory changes — while still preserving local governmental and public-interest oversight.
Preliminary plans for Phases 1A and 3A of the new home community of Middlebrooke were approved on December 10, 2020.
Preliminary plans for Phases 1B, 3B and 4 of the new home community of Middlebrooke were approved on January 6, 2021.
Preliminary plans for Phases 2, 5A , 5B and 6 of the new home community of Middlebrooke were approved on February 15, 2021.
The Middlebrooke project began its initial 2-year period of vested rights on January 1, 2024 pursuant to the Permit Extension Joint Resolution of 2023, approved by the General Assembly. The project’s current vested rights period for the plans for all phases of Middlebrooke will expire on January 1, 2026. The developer has requested a 1-year extension under the Land Development Regulations, which permit vested rights to be extended in 1-year increments, up to a maximum of five extensions, resulting in a total vested period of seven years. This represents the first extension request for the project, leaving four additional extensions available. This 1 year extension for Middlebrooke was approved by the Horry County Planning Commission on December 4, 2025.
